1. Eligibility: Entrant must be from a Channel One school, between 13-18 years
of age, and a legal resident of the 48 contiguous United States and the District
of Columbia as of March 12, 2002. Employees of Cingular Wireless and Channel
One News ("Sponsors") and their respective parents, subsidiaries, affiliates,
advertising and promotion agencies and their family members and/or those living
in the same household are not eligible to enter.
2. Timing: Promotion begins at 7 p.m. PT on March 12, 2002 and ends at 4 p.m.
PT on March 13, 2002 (10 p.m. ET March 5, ends at 7 p.m. ET March 6)
3. How to Enter: There are two ways to enter. To enter online, go to ChannelOne.com
and find the ‘Cingular Question of the Day’ area and submit your answer
and comment along with your first name, last name, age, school name, city and
state of residence between the hours of 7 p.m. PT March 12, 2002 and 4 p.m. PT
on March 13, 2002. To enter by phone, dial the toll-free number 1-866-835-5241
from a touch tone phone between the hours of 9 a.m. PT and 4 p.m. PST on March
13, 2002. Follow the instructions and give the information asked by leaving a
verbal message. Please be sure to speak clearly and leave your first name, last
name, age, school name, city and state of residence. A maximum of 2000 callers
that have completed their call by 4 p.m. PT on March 13, 2002 will be eligible
to enter. Sponsors will randomly select 50 phone comments to proceed to the contest
round. The odds of moving to the contest round depend on the number of actual
calls received. Only one call per person. Sponsors shall not be responsible for
lost, late, mutilated or misdirected telephone entries that are lost or damaged
due to equipment or other malfunction or failure. Multiple entries are not permitted.
More than one entry from any person or e-mail address will void all entries from
that person or e-mail address. Entrants can only participate through one entry
mechanism. If the phone line is busy or mailbox is full during the promotion,
please go to ChannelOne.com to enter your answer and comment.
4. Judging Criteria: Each entrant selected as a potential winner must comply
with all terms and conditions set forth in these Official Rules, and winning
is contingent upon fulfilling all such requirements. Two winners will be chosen.
From the 50 random phone entries selected, one winner will be selected based
on the creativity and ability to express comment in a clear and concise manner
in equal measure. From the web entries, one winner will be selected based on
the creativity and ability to express comment in a clear and concise manner in
equal measure. All segments of the promotion will take place under the supervision
of Sponsors. Participants agree to be bound by these rules and the decision of
the judges, whose decisions are final and binding in all matters related to this
promotion. Chosen entries will be aired on Channel One News ("Program")
for The Cingular Question of the Day answer segment. Winners’ name, age,
school name, city and state of residence, and comments will be read on the Program
on March 14, 2002. By entering this promotion, implied permission is given to
Channel One News to air selected entrants’ name, age, school name, city
and state of residence, and voice recording in connection with the Channel One
News Question of the Day answer segment and all elements thereof, including but
not limited to broadcasting, promotional and online purposes in any and all media
whether now existing or hereafter devised throughout the universe in perpetuity.
5. Prizes: The following prizes will be awarded:

Approximate Retail Value: $250.00 each
6. Total Approximate Retail Value of All Prizes: $500.00. Sponsors are not responsible
for lost or mutilated prizes and none will be replaced. Prize is nontransferable
and must be accepted as awarded. No cash or other substitution may be made, except
by the Sponsors in the event that the prize cannot be awarded for any reason,
in which case, Sponsors will award a prize of equal or greater value. All taxes,
fees and surcharges on prizes are the sole responsibility of winner. If winner
is not in a Cingular Wireless coverage area, prize of equal or greater approximate
retail value will be substituted. Substituted prize is at the discretion of the
Sponsors.
7. Other Terms and Conditions: Potential winners will be required to sign and
return an Affidavit of Eligibility, Liability Release, and where lawful a Publicity
Release, within seven (7) days of notification, failing to do so will result
in the potential winner being disqualified. If any prize or prize notification
is returned as non-deliverable, the potential winner will be disqualified. By
accepting prize, the winner agrees that the Sponsors will have the right to photograph
the selected entrant. Entry constitutes permission to use the entrant’s
name, picture, likeness, school and city and state of residence for purposes
of trade, publicity or promotion for no additional compensation. All entries
must be original, must not have won previous awards and must not infringe on
any third party rights. Submission of entry constitutes consent of entrants and
their parents/legal guardians to irrevocably assign to the Sponsors all rights
in the entry, including but not limited to, intellectual property rights. Submission
of an entry grants Sponsors and their agents the right to publish, produce, use,
adapt, edit and/or modify the entry in any way and in any and all media, without
limitation and without compensation to the entrant, or their parents/legal guardians.
By submitting entries to the Promotion, the sender grants permission for the
Sponsors to use his/her first and last name, age and state of residence and voice
on "Program" and his/her first name, age and state of residence on
ChannelOne.com. No personally identifiable information from children under 13
will be posted online. Entries with the following inappropriate content will
not be considered: lewd, foul or obscene language or depictions; the promotion
or solicitation of illegal activity; or speech that demeans or defames a person
or group on the basis of gender, race, ethnicity, religious affiliation or national
origin. All entrants release the Sponsors, their affiliates, parents, subsidiaries,
directors, officers, employees and agents, and all others associated with the
development and execution of this Promotion from any and all liability for injury,
loss or damage of any kind resulting from participation in this Promotion. Sponsors’ decisions
relating to all aspects of this Promotion are final.
8. Miscellaneous: All entries become the sole property of Sponsors and none will
be returned. In the event of a dispute, entries made by Internet will be deemed
made by the authorized account holder of the e-mail address submitted at the
time of entry. The "authorized account holder" is deemed the natural
person who is assigned to an e-mail address by an Internet access provider, service
provider or other online organization that is responsible for assigning e-mail
addresses for the domain associated with the submitted e-mail address. A potential
winner may be requested to provide Sponsors with proof that the potential winner
is the authorized account holder of the e-mail address associated with the winning
entry. If for any reason the Promotion is not capable of running as planned,
including due to infection by computer virus, bugs, tampering, unauthorized intervention,
fraud, technical failure, human error or any other cases beyond the control of
Sponsors that corrupt or affect the administration, security, fairness, integrity,
or proper conduct of the Promotion, Sponsors reserve the right in their sole
discretion, to disqualify any individual who tampers with the entry process,
and to cancel, terminate, modify or suspend the Promotion. Sponsors assume no
responsibility for any error, omission, failure, theft or destruction or unauthorized
access to, or alteration of, entries. The telephone network or lines, computer
online systems, servers, or providers, computer equipment, software, failure
of any e-mail or entry to be received by Sponsors on account of technical problems
or traffic congestion on the Internet or at any web site, any combination thereof,
or otherwise, including any injury or damage to entrant’s or any other person’s
computer related to or resulting from participation or downloading any materials
in the Promotion. Sponsors assume no responsibility for any phone line, computer,
online or technical malfunctions that may occur or for any lost, late, misdirected,
illegible, postage-due or mutilated mail. CAUTION: ANY ATTEMPT BY AN ENTRANT
TO DELIBERATELY DAMAGE ANY WEB SITE OR PHONE LINE OR UNDERMINE THE LEGIMATE OPERATION
OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH
AN ATTEMPT BE MADE, SPONSORS RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH
PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
